REPORT OF THE EXECUTIVE

 

 

1.0       PURPOSE OF THE REPORT

 

1.1       To provide Full Council with details of reports received and decisions made by the Executive and any subsequent recommendations to Full Council since the last meeting of the Full Council (County Council) on 22 and 24 February 2023.

 

 

2.0       DETAILS OF THE MEETINGS

 

2.1       The following sections provide details of decisions made by the Executive and recommendations to the Full Council since its last meeting on 22 and 24 February 2023.  The meetings were held on the following dates:  21 February 2023 (Performance Monitoring) and 21 March 2023 as North Yorkshire County Council, and 18 April 2023, 2 May 2023 and 9 May 2023 as North Yorkshire Council.

 

2.2       A meeting of the Executive scheduled for 14 March 2023 was cancelled.

 

2.3       21 February 2023 Executive Meeting

            The Executive Members met on Tuesday 21 February 2023.  Attending the meeting were:  County Councillor Carl Les in the Chair and County Councillors Gareth Dadd, Derek Bastiman, Michael Harrison, Simon Myers, Janet Sanderson, David Chance, Keane Duncan, Greg White and Annabel Wilkinson.

 

In attendance: County Councillors David Ireton, Karin Sedgwick, Paul Haslam, Alyson Baker, Barbara Brodigan, Caroline Dickinson, George Jabbour, Andrew Lee and Malcolm Taylor.

           

Substantive agenda items were:

 

·         Q3 Performance Monitoring and Budget Report

·         North Yorkshire Hackney Carriage and Private Hire Licensing Policy 2023 and Adoption of the Local Government (Miscellaneous Provisions) Act 1976

·Creation of new Property and Estates Company – Align 2

·         Closure of Scarborough & Ryedale Community Health and Social Care

·         Appointments to Committees and Outside Bodies.

A verbal update was provided by County Councillor Derek Bastiman at the re-convened meeting of the County Council held on 24 February 2023 regarding the item on the North Yorkshire Hackney Carriage and Private Hire Licensing Policy 2023 and Adoption of the Local Government (Miscellaneous Provisions) Act 1976.

           

2.4       21 March 2023 Executive Meeting

The Executive Members met on Tuesday 21 March 2023.  Attending the meeting were:  County Councillor Carl Les in the Chair and County Councillors Gareth Dadd, Derek Bastiman, Michael Harrison, Simon Myers, Janet Sanderson, David Chance, Keane Duncan, Greg White and Annabel Wilkinson.

 

In attendance: County Councillors Caroline Dickinson, Paul Haslam, Nick Brown and    George Jabbour.

           

Substantive agenda items were:

 

·                     Approval of Customer Service Standards and Policies

·                     Proposal to close Hovingham CE VC Primary School, Hovingham

·                     Skelton Newby Hall CE VC Primary School – School Closure Proposal

·                     Harmonised Fee Structure for Hackney Carriage and Private Hire Licensing across North Yorkshire from 1 April 2023

·                     Approval of North Yorkshire Council Maximum table of fares for Hackney Carriage Drivers from 1 April 2023.

·                     A59 Kex Gill Project Development – Grant Acceptance.

·                     Recommendation from the Audit Committee.

·                     Appointments to Committees and Outside Bodies.

The scheduled agenda item on Community Networks was deferred to a later Executive meeting date to allow extra time for officers to develop a robust proposal.

 

2.5       18 April 2023 Executive Meeting

The Executive Members met on Tuesday 18 April 2023.  Attending the meeting were:  Councillor Carl Les in the Chair and Councillors Gareth Dadd, Derek Bastiman, Michael Harrison, Simon Myers, Janet Sanderson, David Chance, Keane Duncan, Greg White and Annabel Wilkinson.

 

In attendance: Councillors Paul Haslam, George Jabbour and Neil Swannick.

·                     Lowering the Age Range of Overdale Community Primary School

·                     Proposal to amalgamate Caedmon College Whitby and Eskdale School

·                     Appointments to Committees and Outside Bodies

·                     Area Constituency Committee Feedback Report.

2.6       2 May 2023 Executive Meeting

The Executive Members met on Tuesday 2 May 2023.  Attending the meeting were: Councillor Carl Les in the Chair and Councillors Gareth Dadd, Derek Bastiman, Michael Harrison, Simon Myers, Janet Sanderson, David Chance, Keane Duncan, Greg White and Annabel Wilkinson.

 

In attendance: Councillors Paul Haslam, George Jabbour and Bryn Griffiths.

·                     Local Area Special Educational Need and Disability Strategy

·                     Approval of Housing Complaints Policy

·                     NYC Electric Vehicle Public Charging Infrastructure Rollout Strategy

2.5       9 May 2023 Executive Meeting

The Executive Members met on Tuesday 9 May 2023.  The Executive Members met on Tuesday 2 May 2023.  Attending the meeting were: Councillor Carl Les in the Chair and Councillors Gareth Dadd, Derek Bastiman, Michael Harrison, Simon Myers, Janet Sanderson, David Chance, Keane Duncan, Greg White and Annabel Wilkinson.

3.0       MATTERS FOR APPROVAL/INFORMATION AT FULL COUNCIL

 

3.1       The Executive considered the reports and resolved to recommend the following to the meeting of Full Council for consideration:

 

3.2       Local Area Special Educational Need and Disability Strategy

This item was considered at the meeting of the Executive on 2 May 2023, where Executive recommended to Council on 17 May 2023, that the Local Area Special Educational Need and Disability Strategy be formally approved and adopted.

           

RECOMMENDATION:

 

i)      That the Local Area Special Educational Need and Disability Strategy be formally approved and adopted.

3.3       Implications of TUPE

This item was considered at the meeting of the Executive on 2 May 2023, where the Executive recommended to Council on 17 May 2023 that it approves the estimated costs outlined in Appendix 1 (confidential as it contained exempt information) and approved submission of the estimated costs to full Council.

 

 

RECOMMENDATION:

 

i)      That Council approves the estimated costs, as detailed in para 6.1 of the report, as they are over £100,000.

3.4       Waste Collections – Separate Collection of Food Waste

            This item was considered at the meeting of the Executive on 9 May 2023, where the Executive recommended to Council on 17 May 2023 that the DEFRA transitional arrangements be accepted and that options are explored for the separate collection of food waste at an earlier implementation date.

           

RECOMMENDATIONS:

 

i)      To accept the DEFRA transitional arrangement to implement separately collected food waste across North Yorkshire from 1 February 2043;

 

ii)     To explore options for NYC to implement separately collected food waste at an earlier implementation date and to engage with DEFRA and Government to ensure that an earlier implementation date does not negatively affect our eligibility for funding.
